This writ petition has been filed under Article 226 of the Constitution of India, whereby the petitioner-Bank has sought a direction to respondent no.1 to handover the original title deeds and other relevant documents to the petitioner-Bank. 4. The facts of the case as narrated by the petitioner- Bank in the writ petition are that the borrower-respondent nos.3, 4 and 5 took loan from the respondent no.1 and further to repay the loan of respondent no.1 has again got sanctioned loan from petitioner-Bank. The petitioner-Bank disbursed the loan and the amount which was outstanding against the borrower was paid by the petitioner-Bank to respondent no.1. 5. Since the outstanding amount of loan against the private respondents was cleared by the petitioner-Bank, therefore, he made a request to the respondent-Bank to handover the documents of the property to the petitioner- Bank which has not been done. 6.
